Truck rammed my car how can I claim compensation

I had a nasty accident where TATA 407 truck jumped the median on the airport flyover and rammed into my car. Right and back (body only) of my car is completely damaged. The estimate given by the service station is 4.3L. I have filed an FIR and complaint at Police station 1. Wanted to check as per the insurance policy is there any limitation on the claim. MY IDV of the vehicle is 3.1 L 2. The truck owner asked me to claim the repair and medical charges thru 3rd party insurance. Is it possible? Can you let me know the basic steps so the i could take legal help.
In case of a motor vehicle Accident the Insurance Company of the vehicle pays the Compensation to the victim provided the vehicle had a valid insurance policy on the date of the accident and the driver of the vehicle had a valid driving license.
