Someone crashed my car insurance policy lapsed will police file FIR

My two wheller's insurance policy has been lapsed now someone has crashed my vehicle now if I go to lodge FIR do police will raise any question regarding not having insurance .if yes then what is the remedy.I don't want to claim any money from insurance co.but I want to put culprit behind bars.pls help
When you drive a vehicle you need third party insurannce as per Section 146 of the Motor Vechile Act Since you do not have the same, we do not suggest to go ahead with lodging of police complaint
