Remedy in case victim is not having the license in Motor Accident

My friend had dashed a two Wheeler who crossed the road and his leg was broken he was driving the bike without license now he is asking money for treatment what should he do the incident happened 3 days ago will the police book case towards my friend or what should he do my friend was driving a two Wheeler with license and the victim don't have license kindly
in this case the victim himself was at fault . if you go to the police then he himself will be at fault as he was not having the license in this case police can register case against him and his vehicle can also be taken into custidy.
