Procedure to claim compensation in case of motor accident

My brother undergone accident yesterday.He was riding a motorcycle & driving from let side the truck coming from front side dashed him.his right side of body got lot of injuries .his right leg thumb & index finger broke in this accident. How this case can be put in the case & the expenses of damage can be recovered from the opposite party who is responsible for accident.
If the vehicle which hit your brother had a third party insurance then you will have to implead Insurance Company as one of the parties to the Compensation Application which is to be filed before the Motor Accident Claim Tribunal.
