Person died in motor accident by vehicle coming from wrong way

A Tata ace vehicle today hit my father in the wrong side area of state Highway. And my father is died on the spot. The vehicle has have all the valid document along with the vehicle insurance. We are four son of my father as legal representative. So how can we get the motor accident compensation?
In case of a motor vehicle Accident the Insurance company pays the Compenstion to the victim provided the vehicle had a valid insurance policy on the date of the accident and the driver of the vehicle had a valid driving licence.
