I hit a man and he died, FIR not filed yet. How to defend myself ?

on 28th jan my friend was driving bike with triple loading (he has no license and bike is not transferred on his name yet)bike hit a man.the man was dead an my friend had major injure and he is in hospital now other two person on bike are ok fir is not loaded now person who dead is unmarried and his family member demand for 4 lac police said they fill fir after postmortem report come my friend is in defense force and is on the leave now what type of problem we may face now
It is definitely a serious issue attracting strict charges and penalty. It's an criminal offence of negligent driving covered under Indian Penal Code and penalty will also be levied under Civil law i.e. Motor Vehicle Act. If deceased family is asking 4 lakh to rest the matter , it is advised to settle the case outside court.
