Got into accident and the other person promised to pay damages

Last month when i drove back to my home in bangalore i hit another car (mostly its my mistake), after a long dispute we mutually agreed that i will pay the complete service bill and he will pay back the insurance claim amount. The bill is for amount around Rs 29, 500 and insurance claim got approved for around Rs 22, 500 and claim amount got credited to his account 2 weeks back, but now he is refusing to pay the claim amount. Do i have an option to file a case ? how do i recover the money? I have the proof for the payment i have made for his car servicing. Please suggest.

If you have it in writing that he will return the money, then you have a case. But in some cases a victim is not allowed to claim compensation from the person who caused the accident (you) AND the insurance company so it is likely that you can still file a case. Please collect all documents - including proof of the deposit made by the Insurance company to him and also proof of payment made by you to him for filing a case.
