Father lost leg in accident how to claim compensation

We got an accident last week I was driving the bike my father was also with me, a private bus came opposite side (it was overtaking a car ) and we both fell down and we got serious injurys , yesterday doctots cut my father's right leg, so how can we proceed
In case of a motor vehicle Accident the Insurance company pays the Compenstion to the victim provided the vehicle had a valid insurance policy on the date of the accident and the driver of the vehicle had a valid driving licence.
