Fake Hit and Run FIR against me, can I file demation case

I have been framed in fake hit and run case under section 281 and 125(B). I had a very minor accident on highway in pilakhuwa(hapur) with a bike where he was driving rash on 3rd November 24. I immediately took him to hospital and got him treated and paid for all medical expenses and also gave 5000 rs to thebrother of victim. We made a discharge
time video too and have all bills.he did FIR on 13th Nov for extracting more money from me.
Police took my vehicle without court order from my home.
