Defense in case of accident of motor bike

14-Jul-2023 (In Motor Accident Law)
I was riding the bike on new airport road(that is 6 lane highway). I was at a speed of 50-60 kmph and a lady was crossing the road from divider to other side by running and that time collision happened. She came suddenly and collided. Now Police has raised FIR against me. That lady got admitted to hospital and now she is discharged from hospital and yet to recover completely. As she collided and fall down, she got injury in brain also(Doc said she will be recover). Now the problem my side was that my motorbike insurance got lapsed two months back. So the claim will come on me. But I was not at fault while riding bike. I had proper D/L, R/C and wearing helmet while riding the bike. We only went to Police station to report the accident. However, FIR is against us. In my situation, as that lady suddenly ran and collided with on 6 lane highway(there was no zebra crossing or signal), How should I defend myself as I am not at fault side?

As the FIR is already registered so there will be a court case. However if there is the mutual understanding between you and that lady then you can go for quashing of FIR in the high court. If there is no understanding then you can hire a lawyer to defend you in the case by preparing good arguments.
