can i claim medical expenses from OLA on accident by there driver

I had a car accident due to the complete carelessness of the Ola cab driver. He was fiddling with the phone when he went straight ahead and crashed into another car. Due to this, I have been suffering quite a bit with the injuries, medical expenses, no salary since I have to be on leave. They seem to not have any policy on this, what if I had lost my life, would an apology over the phone work for a life lost. My point is I have been physically, mentally harassed and also financially burdened just because of Ola cab. What can I do here to get some justice? Please advice.
