accidental death compensation from the person who hit kavita's husband

kavita's husband was hit by underage boy who was riding a two wheeler with another girl behind him. he is minor. he hit so hard that rakesh went into coma state there only. and died on 3rd day. now we are trying to get the girl kavita who is 41 some compensation from the insurance company of 3rd party. that is the vehicle owner's insurance company. as kavita is poor maid. so it will help her to some extent. pl guide how to go ahead in this case
You need to file an application at Court with proper format along with FIR,Spot Panchnama, Inquest Panchnama, Papers of vehicles and other. so According to that court will scquitnize your documents and then issue notice to insurance company so according to his level of income dependency and Age and avilable evidence court award the Damages amount that case must be filed with advocate and it will take minimum 2-3 Years
