Accident while driving without license
21-Jan-2023 (In Motor Accident Law)
While driving car, accident happened and opposite party was injured. FIR launched against me for IPC 279/338. Settlement done with injured person and he is ready to withdraw the case, however i doubt whether case against state will close or not and how to proceed for quashing of FIR.
you can definitely proceed with quashing the FIR under section 278 and 338 IPC. the settlement reached between the parties will help in quashing the FIR. there are numerous case laws which support the same.
if the party is ready to settle so it is easy to quash in the Honarable High Court.
but to make it clear section 279 IPC is not that easy if the party refuses it can be turned against u as well..the nature of the crime is also important and this should be ur first offence then it is smooth to get quashing.
