The limitation period in medical negligence cases generally depends upon the nature of the case and the date on which the negligence came to your knowledge. In consumer cases, usually a complaint has to be filed within 2 years from the date of cause of action, though delay can sometimes be condoned by the court if sufficient reasons are shown. In civil suits, different limitation periods may apply based on facts and damages claimed. Therefore, if you explain the date of treatment, negligence and when you discovered the issue, it can be assessed whether the case is still maintainable before the appropriate forum.
