Sir if a mentally sick person commits a cyber crime unintentionally in heat of the moment and their is no witness too.will he get arrested? How can he prove that it was done unintentionally by him?
It is not a offence when a person of unsound mind commit any offence. But, if it is done in the lucid interval is a offence. Mentally sick is a vegue term in a court of law. Degree of unsoundness of his mental state is only parameters.
