Consumer Case Remanded – When Will the District Commission Proceedings

14-Jul-2026 (In Medical Negligence Law)
My consumer medical negligence complaint was allowed ex parte by the District Commission. My husband is the direct consumer; I filed it as Party-in-Person with his consent but without a POA. In appeal, the opposite parties raised maintainability and, after depositing the mandatory 50% amount, the State Commission allowed the appeal and remanded it without allowing me to oppose or take my SPA-cum-Ratification on record. The detailed judgment is still unavailable. Should I wait or enquire at court

Once the State Commission has allowed the appeal and remanded the matter, the operative directions will depend upon the detailed remand order. Therefore, first obtain a certified copy of the judgment. If your grievance is that the remand was ordered without giving you an opportunity of hearing or without considering the SPA/ratification, you may explore appropriate remedies after examining the reasoning in the order. You need not remain passive—enquire with the registry regarding uploading of the judgment and apply for a certified copy immediately. If the remand proceedings commence, place the duly executed SPA/ratification on record before the District Commission and raise all maintainability and procedural objections at the earliest.
