Divorce when spouse is missing


If your spouse is missing for a period of seven years, you can file for a divorce based on this reason. But there are certain things that you need to do before filing the divorce:
  1. You must file a missing complaint in the police station and take all possible steps to find your spouse before filing a divorce.
  2. Your spouse should be missing for at least 7 years, if you want to file for a divorce under this reason.
  3. Hire a divorce lawyer and get your divorce petition made.
  4. File the divorce petition in the District Family Court.
  5. Attach a copy of the police complaint with the divorce petition.
  6. The divorce petition should be sent to your spouse’s parent’s address.
  7. After receiving the petition, your spouse is required to appear in the court. If he/she does not appear in the the court, it shall proceed with your divorce.
  8. In most cases, the court orders divorce within 3 to 6 months, but the same is not certain.
