What is Ancestral Property?

Undivided property, in which 4 generations of a single family have their share in, is called ancestral property.

Such property, once divided among the members having stake in it, turns into self acquired properties, from ancestral property. As per Hindu Laws, the right to share in ancestral property begins at the time of birth of the child.

Women’s Rights in Ancestral Property

After the 2005 amendment made to the Hindu Succession Act, 1956, the daughters were also given the same coparcener rights as that of sons and share equal rights and liabilities over ancestral properties.

Laws Governing Ancestral Properties in India

In India, Hindu Succession Act 1956 governs Hindus, Sikhs, Jains and Buddhists. Christians are governed by the Indian Succession Act 1925, while Muslims are governed by Muslim Personal Law (Shariat) Application Act, 1937.

The laws and legal procedures to divide ancestral property may involve filing of partition suits, sending of legal notices, appearances in court and drafting of several legal documents.
