After notice, Sec 138 complaint must be filed within 1 month after 15-day notice period. Civil suit limitation is 3 years. Court fees depend on state (ad-valorem).Advocate fees vary by court/case depending upon Experience, his Qualification, Knowledge, Good Will.

When an owner asks for an extra amount, the first thing to check is what exactly is written in the agreement. The owner can ask for additional money only if there is a clear clause mentioning the reason, amount, or formula for calculating it (for example: extra area, additional amenities, taxes, escalation, or maintenance). If the agreement does not mention any extra payment, or only has a vague line like “charges as applicable” or “as decided later,” then the owner cannot demand money on his own. Any extra payment must be mutually agreed in writing. Verbal assurances or pressure have no legal validity. An owner cannot change terms after signing or demand money just because possession or registration is pending.
