Is Notary Registered Rent Agreement Legal?

03-Sep-2023 (In Landlord/Tenant Law)
I am a Tenant and living on rent in Delhi/Gurgaon for the last couple of years. I have lived at diffrent places. I have noticed that the Rent/Lease Agreements are easily made by some local photocopy shops and they are themselves doing notary registration. The landlords are able to add any clause they want regarding Lock-in period, the return of Security deposit, last month rent, etc. 1) At one place the lock-in period was 6 months and another place it was 11 months (mentioned in the rent agreement). 2) In one of place, it was mentioned in the rental agreement that the last month rent will not be adjusted with the security deposit. 3) At one of place, it was mentioned if I continue to stay after the eleven months without lease agreement gets renewed, I will have to pay per day 700/- Rs and the lease agreement was for 11 months. Is this legal - the rent agreements made by some local shops and lanlords are able to add any clause? Please advice.

See, notary should be done by proper notorised officer. Because at maximum places notary officer are not doing attestation in a proper manner thats why they do for 20-50 Rs. You have a defective lease agreement which has various defects which has typography error and not attested by proper notary officer.

the first step is to file a written application to the police / concerned authorities. if there is no response from the said agency. then you have a option to approach the higher appropriate authority. if all else fails then approach the Hon'ble court by explaining in detail your case.
