I have a query about a tenant matter who was promised possesion

there was a tenant in our old house , my dad made a settlement with him for 200sq feet shop and taking 335000/- at possession and let us to make a construction, now me and my sisters are opposing to it to not to give a shop to him , as i need a shop for me to start a new bussiness for myself, but my dad made agreement in court,possession is with us can i fight for it please advice

Yes, you can fight the case against tenants becase you require the premises for bona-fide use. First we need to issue notice to tenants denying him any rights over the property. After negative response from tenants, we need to approach court for getting relief. Please contact for further discussion and advice.

You mean to say the consent terms were made before the court?? What agreement you meant. If consent terms were executed then who had filed the matter. It is necessary to go through the consent terms of any.
Secondly you can file the Suit under ground of bonafide requirements against the tenant. The suit is to be filed by the Landlord. If your father is alive then he will have to file such suit and if he has exploited then you can file it.

Dear Querist,
The facts are little incomplete. Whether you have a valid title in the property than you can certainly challenge the consent decree/settlement made in the court and also seek injunction from court of law.
