Can a flat be rented for employment purpose in a Residential area

We are planning to recruit an apartment manager for our residential apartment. We are planning to pay him directly and also he would occupy one of the flats in our apartment that is presently used as an office room. Please let me know if there are any employment laws that we need to adhere to? We have initiated his back ground check but want to make sure that we dont violate any Government guidelines if he is party to any wrongdoing. Also, do we need to sign a rental agreement with him for living in the office room? Regards,

As per your facts no employment laws are rules applicable because the number of Person you appointed is one so Labour laws ,rules or work men compensation Act or industries act not applicable

If done every thing as per law pertaining to apartment, the urban apartment guide lines applicable.
You have providing space for manager in managerial capacity where in case of dispute arises you cannot give up your hand for him to claim as a manager,as the possession himself proof and in case of casualties in the apartment to his family he can claim compensation under tortious liability on the ground such casualties occurred during the course of employment in discharge of apartment duties.

Better have rent agreement and try to keep on record only the land Lord and tenant relationship.
Don't mention any where the flat intending to rent him as office
Once u mention the word office it is open for him to opt all possible laws

Sir,I gone through your question, there is a law. you have to take a permission from labour office. then you have to pay salary as per wages act and then he is entitle for all benefits under concern law. If it is a firm or association,company,etc registered under competent law,then you have to follow rule and regulations. It is better, if you will not commitment the appointment by writing. Let him be as an unregistered employ to avoid legal consequence. If you want to recruit him legally, you can take an advice from auditor.
