Appartment Association asking tenant to transfer fees in Bangalore
21-Apr-2023 (In Landlord/Tenant Law)
I am Ranjeet Mishra living in Bangalore since last 5 years. I am about to move to Salarpuria Sattva apartment next weekend as a tenant with my family. The building management association is asking for Rs. 5700 as entry permission fee? Is this allowed? Can they really charge such a huge amount? Money is not an issue for me but the way they are looting tenants for entry and eviction fees is wrong. What can I do about it? I do not want my owner too to pay for it. For Gurgaon here is ruling news I found. http://timesofindia.indiatimes.com/city/gurgaon/Tenants-can-complain-against-RWA-on-transfer-fee-Gurgaon-administration/articleshow/46777730.cms
sir, If your landlord was a member to that association, he is bound to share the same as per its bye-law. Ask them whether it is returnable or not at the time of vacating the premises. If, it is returnable, think to do so. You can issue notice by an advocate for calling better explanation to the association that, if not at all pay the entry fee, what will be the result to such tenant. All times, law does work. Mass rule is applicable in some conditions, but, it may or may not be legal one.
Your social live is controlled by social enactments like THE KARNATAKA APARTMENT OWNERSHIP ACT, 1972 and rules there under. You may seek relief to amend such provisions by filing PILs (PUBLIC LITIGATION PETITIONS), IT WILL BE HELP FULL TO ONE AND ALL.
Any charges/fees in an apartment society depend primarily on the provisions given in its registered bye-laws.
In Karnataka, there is no law on the matter either way. Therefore any correct opinion can be formed only after going through the bye-laws.
