A formal legal notice may sent to him for recovery of the rent and eviction from the premises citing personal necessity. Suit for the eviction could be an after step and last resort. The jurisdiction will be decided on the basis on where the property is located.

You can give a Legal Notice to vacate the premises, in case he still occupies the premises. You can file an eviction suit for vacating the said premises and get an eviction order from court. You are advised to give the lease agreement details for more legal remedies.
