Advice in legal process for agreement with tenant for 11 months.

Hi There, I have a property in Ghaziabad which I have leased out to the same tenant for past 4 years 8 month. I keep getting the lease extended every 11 months. Please suggest if it is safe to keep the same tenant for so long... In case it is safe, please confirm the best legal way to manage the scenario. Thanks
It is irrelevant that how old the tenancy is bcoz if a person is in possession of any property than he can be evicted without due process of law u should receive rent by way of cheque and make ur agreement registered every time and mention some terms as if he is not vacating rented premises after expiry of tenancy and no fresh agreement is executed between you and tenant than tenant is liable to pay damages for use and occupation of that property at a higher rate and mention that rate in agreement

11 months agreement itself create monthly tenancy after expiration of 11 months period tenancy itself comes to an end if on account of tenant not vacating you can take legal action by filing ejectment and damage suit against tenant

Yes, it is completely safe to continue with the same tenant. Make sure that the agreement is a registered and when u make a new lease agreement then the previous one gets automatically expires and now the tenancy period starts from the date of the new agreement. In case u forget to continue the lease agreement then also don't worry as in the absence of any written document then the lease is deemed to be from month to month, terminable by fifteen days notice.
