Salary not paid & illegal termination without notice period

The company terminated illegally with no reason or information and notice period as per contract after 3 months but deducted TDS from salary of May and June 2024 months salary and didn't pay salary for July 2024. In IT Returns I found that company falsely claimed as salary paid to me with fraudulent intention.

You may first issue a legal notice demanding unpaid salary, notice-period dues and correction of incorrect TDS records. If the employer fails to comply, appropriate legal proceedings may be initiated.

The employer’s failure to pay salary despite deducting TDS can give rise to claims for unpaid wages/salary and breach of contract. If the employer has reported the salary as paid in Form 26AS/AIS or TDS returns when the amount was actually not received, preserve your bank statements, salary slips, Form 16, Form 26AS/AIS, employment agreement and termination communication. The TDS entry alone does not establish that the salary was actually received by you. Depending on your designation and employment status, appropriate proceedings may be initiated before the competent labour authority or civil forum, along with appropriate action regarding incorrect TDS reporting.
