Salary not credited for May month

02-Jun-2025 (In Labour & Service Law)
I work in corporate. I have resigned on 14th May. I am currently serving the notice period. My last working date is 12th June. I have not received my May month salary. They are telling they will credit my May month salary in final settlement. But my last company paid me while I was on a notice period. Do company have rights to withhold my May month's salary as they are saying it is my last month, but June is my last month?

Companies tend to pay the salary along with full and final settlement amount. So, your salary has not been credited for the month of May then you should wait as they shall pay you along with your other dues. Feel free to contact me got seeking any legal advice as regards the same.

No, they do not have any such rights to withhold the salary unless the same is mentioned in the contract you've signed. However, they may have stated it as per step of mutual understanding, but you have all the rights to claim your salary for the month of May.

Well, I think, you need to serve them a Legal Notice in order to get your Outstanding Salary on time along with other Outstanding Dues! If things work out from sending Legal Notice, then, well & good, otherwise, you will have to file a Civil Suit to recover your Outstanding Salary from your Ex Employer!
