Not received full and final settlement from the company?

20-Jan-2023 (In Labour & Service Law)
Sir I was working for a hospital in marketing sector. I Left the organisation on 23 rd of November but submitted my resignation through mail on 15 of November. And I was in a probationary period. It was only four months I worked for the organization. And I had stated in my resignation mail that I was ready to serve the notice period of one month but they relieved me after the 8 days of submitting my resignation. And it has been 45 days I haven't received my full n final settlement and am I entitled to one month's compensation as they have relieved me before serving the notice period

Hi
For recovery of your legal monetary dues you have a remedy under Thd Delhi Shops and Establishments Act.
You may file a petition before the designated officer who is the Dy Labour Commissioner of the zone in which your employer (ex) is located.

Did you enter into an employment contract with your employer? If yes, then do share the details because it would contain a clause regarding resignation and payment of salary in lieu of notice period. If not, then you should immediately send a legal notice to your employer and demand payment of your dues and if your company then fails to pay then you can approach the appropriate labour court for redressal. Dear Sir

This appears to be a good case. However, one will have to look into your employment details. Many documents will have to be gone into before drawing a conclusion but on the face of it, you do have a case here. See them a notice through your counsel and for any other further recourse, contact a lawyer please.

Regards
