My salary is being kept pending for a long time now

Hello Sir/Madam, I had signed a job contract with an advertising agency as Business development manager to bring them x amount of business everymonth but whenever i approached any client and forward the client enquiry to my boss he would take it further without involving me saying that now it is his responsibilty further but unfortunately only one client came on board later on after 6months i resigned and now my 2months salary is pending which he is refusing to pay saying there was no business so i will not pay you and threatens me if i ask for salary he will file a case against me. Please advice
Depending on the post at which you are in the company it will have to be checked whether you fall in the definition of 'labour'. If you do you may already the labor court. Else you will have to file a suit for recovery in the civil court. Ideally each litigant must approach the city separately in this scenario because all employees seem to belong to different categories. You could also approach the High Court for the winding up of the company which may be done jointly.
