Fnf settlement from the company but still they notice me to pay due
18-Jan-2025 (In Labour & Service Law)
Hello sir, I was working in indigo company, I joined 4th october 2022 to 29th June 2024. During the fnf settlement, they send me everything relieving letter, experience letter as well as fnf statement which only 12000 with some deduction, now , they send me again a notice to pay bonus because I resigned from the company on 31st may 2024, I get another fnf mail. What I have to do?
Based on the details provided, it appears there might be a discrepancy in how your full and final (F&F) settlement is being processed. Here’s what you can do:
1. Review the F&F Statement: Check the details of the deductions and confirm whether they were communicated to you in advance. If the deductions are arbitrary or not as per your employment contract, you can challenge them.
2. Understand Bonus Pay Notice: Employers typically deduct bonuses if the employee leaves before a stipulated date, as per the company policy or employment agreement. Verify if this notice complies with the law and the terms of your employment.
3. Seek Clarification: Send an email or letter to HR requesting a detailed explanation of the bonus deduction and the second F&F settlement. Keep all communications in writing.
4. Legal Notice (if necessary): If your queries remain unresolved, consult a lawyer to send a legal notice to the employer. Employers cannot arbitrarily demand payment or make deductions unless justified by law or policy.
5. File a Complaint: If the employer fails to address your concerns, you can file a complaint with the Labour Commissioner’s Office in your jurisdiction or approach a court for recovery of dues.
Make sure to act promptly and document all communication to strengthen your case.
Dear
kindly provide all necessary documents like appointment letter, your terms of service for a better understanding of your matter. However from the facts that you provided, it is clear that fnf settlement is complete and if the Employer is still sending you Notice, you need to reply to this Notice by providing complete information of your settlement.
