Employer forcing extendd work hours & terminating employees who refuse

Hello, I work at a public company where we’re regularly forced to work from 10:30 AM till midnight/early morning and also on weekends. If we don’t respond after hours, management taunts us and says this is a “startup culture.” Recently, employees who refused had probation extended and one was asked to resign. Is this legal? What rights and remedies do we have under Indian labour law?

Forcing work till midnight and on weekends without overtime may violate Shops & Establishments Act/Factories Act. Probation extension or forced resignation can be challenged as unfair labour practice. You may complain to Labour Commissioner or file dispute.

Forcing excessive hours and penalizing refusals violates the Factories Act and Shops & Establishments Act. You can claim overtime pay or file a complaint with the Labour Commissioner for harassment as per the concerned provisions of law.
