Due to my back pain I have resigned from my position.

Company is not paying me salary & not replying to my mails as well.

Well, if the Company has not been paying you the Outstanding Salary, then, you first send a Legal Notice to them, if things won't work out from sending notice, then, you can file a Civil Case against them in NCLT to initiate CIRP under IBC Act, 2016. In order to run case before NCLT, you need to send a Demand Notice first as per the prescribed format available in IBC, 2016.
