Company charging for the loss suffered due to my mistake

Dear Sir/Madam, I want to know that I am working in the private travel company and still working with the same company. I did a mistake and for that mistake company is charging me INR.43000/- from my salary. I want to know whether it is legal to charge amount from the executive ? as I checked with other companies and they all informed me that no company will charge that much amount from an executive. they can ask the executive to resign and take the maximum loss of INR.10-15K for the big blunder. so now I want to file a case and want compensation for the same. is it possible or not?

If there is evidence, that loss has been caused due to your mistakes, your employer has right to seek compensation from you on account of loss incurred, though other companies may not do so. Yes the company can in alternate or in addition ask for your resignation.

It will depend on the contract that you signed with the company and whether as per the contract they have made recoverable the loss caused by you to the company. If the Contract allows the company to recover the entire loss then it would be legal however if there is no such provision in the contract then it would not be legal for the company to deduct from your salary. You may file a case against them and claim damages and recover the principal amount however you will have to be mindful of the fact that the Company could also approach the Court and seek damages from you for causing loss to the Company.
