Clarification on procedure related to retention bonus by employer

17-May-2023 (In Labour & Service Law)
Hi, I was given retention bonus letter by company, as I was part of special project for the company, one of the retention bonus letter point was that I should be employed till 31st April 2018. But on 6th March 2018 management (MD &CEO) asked me to tender my resignation in presence of VP HR and VP Sales without sighting any reason. I was asked to write my resignation letter on a piece of paper and immediately I was handed a printed acceptance with immediate effect. The company paid the three month notice pay as mentioned in my appointment letter in April. I could not agitate, as my FnF and gratuity could have been withheld by the company. now once they have paid the money I want to explore my legal option as resignation was asked to save the retention bonus. what is the recourse I have.

Dear Client,

Your issue is not fully clear by your statement as to why the management asked and forced you to submit your resignation instantly and immediately on the point and spot. You may explain in detail about the matter for better course of action.

You may contact me for further advise and suggestions with all relevant documents.

Regards,

HS Verma

This is my response to you:
1. Do you have any written (email or paper) or oral proofs that you were made to resign forcefully?

2. If you have any proofs then you can send them a legal notice with these proofs;

3. Once you send the legal notice most probably they will come forward and settle the matter with you;

4. If they don't then you can approach the labour court/commissioner as and how they respond.
