27-May-2024 (In Insurance Law)
I drove a car and crashed into the median, I was taken to hospital A for emergency treatment. Their medical staff negligent did not rehydrate enough for me, worsening my condition. I have some underlying medical conditions and developed complications, then required another surgery, the second surgery weakened me leading to high risk of heart attack. can I successfully tort claim the hospital? whether there is possible defence for the hospital because of my negligence in speeding initially.?

these are two different transactions. yes proximate cause is road accident but still it does not mean that hospital treat any patients with negligence. this negligence that to be that which has potential to threat to a human being is definitely punishable under various laws. it actually attracts the section of IPC as well. in addition to hospital expenses (if not paid by insurance) the sufferer may claim compensation and opportunity lost.
