deduction in Insurance claim for Theft of New Vehicle

Dear Adviser, my new car had been theft (just two from purchase date), I had insurance with IDV 6.5 lakhs. due to the court process the submission of document got delayed. In between the insurance company sent a letter that your claim has been closed. I have called them and informed that due to court process, we are not able to submit the paper, kindly dont close it. but we have not sent any written document. because of no written submission and Based on this delay, The insurance company is deducting 10% amount from IDV. Kindly advise me is it correct? as per rule or let me know the other possibility to get the 100% insured amount.
