How to convince for mutual consent

I am a Hindu and got married in 2014. Due to compatibility issues, I have been staying separate now for past 6 months. However, the other party hasn't agreed to proceed with a divorce yet. Wat options do I have??

1. If you want to take a Divorce from your spouse you can file a case for Divorce before the Family Court under the relevant Provisions of Hindu Mairriage Act.
2. If you want to that your spouse should stay with you then also law has a provision that you can file a case for restitution of conjugal rights wherein court will order your spouse to stay with you.

This is my response to you:
1. Try approaching a marriage counselor;
2. If your spouse does not agree then approach a mediator;
3. If spouse does not agree then ask for MCD;
4. Even then if the spouse does not agree for MCD then you have to go for contested divorce.

Dear Querist, you have just mentioned a reason of compatibility issue, which can be sorted out by going for Counselling between the parties so that the issue may be resolved and further can be reconciled if successfull please provide full details or kindly consult me on my number for the same.

I suggest you first send a legal notice for one last time before you proceed further. You may file for contested divorce proceeding. If other party does not appear, ex-parte decree can be passed by the court for divorce. You may connect with us for further assistance.
