Correction of Date of birth in passport

02-Aug-2025 (In Immigration Law)
My brother is working in US on H1B visa. He is going for green card application through EB2 category. He has the correct birth certificate issued by Govt. But, during his school admission the date of birth got changed from 25.10.95 to 25.10.96. Now he wants to correct the birth records in all documents in India and USA. If he gets a court order for change of date of birth can he correct his DOB in all US records and apply for green card smoothly?

yes he can do that. you need to make sure he is not getting any social insurance benefit due to his age till now. otherwise he will face complications during the green card application process. They can consider it as a false details benefit taken.

Yes. If he obtains a court order in India declaring the correct date of birth based on the official birth certificate, he can update all Indian records (passport, educational certificates, Aadhaar, etc.). Once the Indian documents reflect the correct DOB, he can request amendments in US records by providing the court order and updated Indian documents to USCIS and other relevant agencies. This will help align records for his green card process. However, US authorities may scrutinize the change, so it is advisable to keep all original proofs and legal orders ready to avoid delays.
