My husband and in laws has thrown me out of the house and i filed dv and 498 and he filed for divorce. But i dont want divorce and i want to stay with my husband and with my in laws. But problem is that my mother in law says it's her house so she can throw me out any time. So for my residencial safety can i ask court , one flat purchase by husband on my name and in that flat me n my husband n my in laws all stay together happily. So no one can throw me out of house and I can get security of living. Can court grant this? Which case i have to do for this? I can't stay in rented flat bcoz my husband run away and I can't stay in my in laws flat they throw me out. I can't stay in my husband flat he also throw me out. And I don't want to break marriage. And from court can i have my husband's child through ivf bcoz he don't want kids and I want kids as right of reproduction . Every women have right to become mother.

Dear queriest, as per your query you have filed 498A and DV, so therefore for your maintenance you can claim in your DV case or file under section 124 of the CrPC. And the question of flat remains when the final order of DV and 498 will be decided, till then it is upon the Hon'ble court whether to give pass an interim order for your residence whether rented or owned. yes you can ask court to order your husband for purchesing flat on your name but for that you mush disclosed your husband's income to court and this can be asked in dv second thinks you can not ask share in in-laws property but you have right to resaide. in dv law you can ask anything dv priamble clearly says that it's an knife in women's hand they can cut the cake or cut the head.
