Wife unable household responsibilities, aged parents, guidance please

20-Mar-2026 (In Family Law)
Married since 2009, 2 children aged 14 and 9. I work in government job and currently under financial pressure due to ongoing liabilities. Wife not working and also has not been able to independently manage even basic household responsibilities (low IQ), although no formal medical diagnosis. Household works handled by my aged parents (around 75+) with 2 part-time maids. My parents are also facing health issues, and this situation is putting increasing physical and mental pressure on them.

From your facts, it is evident that you are under extreme financial and mental pressure due to your wife’s inability to contribute to the household and the burden being shifted onto your aged parents. The law does not expect a husband to suffer indefinitely in such circumstances. If your wife is unable to discharge basic marital and household duties, and this has continued for a long period, it may amount to mental cruelty. Further, if there is any underlying mental condition, the same can also be a valid ground for seeking relief, provided it is supported by medical evidence. You have strong legal options available: File a petition for divorce on grounds of cruelty and/or mental disorder (subject to medical proof). Seek custody of your children, especially considering the welfare of minors and the current environment at home. Limit or contest maintenance, particularly if her condition or conduct is established before the court. Initiate family court mediation, which is often the first step and can strengthen your case if reconciliation fails. Your priority should be to safeguard your mental peace, financial stability, and the well-being of your children and elderly parents. I strongly advise you to proceed with proper documentation (financial records, medical assessment if possible, and proof of household situation) and initiate legal action at the earliest.
