Well, if the concerned Home is on the name of the Wife, then, Husband cannot live in that House, if the Wife does not want to keep him in his Home. However, Husband as he is living separately, he can apply to seek Maintenance from his Wife, if he is financially dependant upon her. However, if the Wife will be able to prove Adultery of her Husband, then, Husband will not get any Maintenance.
In your situation, it's important to address both the false allegations and the harassment constructively. Here are the recommended steps:
1. Gather Evidence: Save all messages, including WhatsApp chats and other communications that can prove the false allegations or harassment. This evidence will be crucial in your defense if the matter escalates legally.
2. File a Police Complaint: If the harassment becomes intolerable or you feel threatened, consider filing a non-cognizable (NC) complaint or a detailed complaint with the police, specifying the false allegations and mental harassment.
3. Send a Legal Notice: Through a lawyer, you can send a legal notice to your wife, asking her to cease harassment and retract false allegations.
4. Seek Protection Under Law: If required, consider filing for relief under Section 9 of the Hindu Marriage Act (for restitution of conjugal rights) or seek other remedies based on your specific circumstances. Additionally, filing for judicial separation or divorce might be an option if reconciliation is impossible.
5. Counseling or Mediation: You may also explore options for marital counseling or mediation to resolve the issues amicably without immediate legal action.
