Who is entitled of shared family pension after father's death

This is reference to subject to shared for family pension of my father who was govt servant ,Who died in 2015 ,Currently step mother is getting full penison. further we have no relation with them. Have a brother who is mentally retired child currently staying boarding special school,His monthly expense is now taken by our brothers. My query - we have already send application to share family pension to concern department(collector) and following since 2 years, however it is unfortunate that we didn't get any response from them , I want to know the legal rights of sons and our step-mother stake on my father's pension.We are 4 brothers and and we found all our name is registered in my father's service book. What should we do?

Unmarried daughter , son below eighteen years and wife are entitled to get family pension . If son is mentally disorder person then he will get family pension for life time. To get immediate relief you are advise to file case in high Court or contact with me

If your father have entered your step mothers name and your physically challenged brother n pension papers then both are illegible for family pension.Apply to the aiuthority copy to AG and pension minister if no responce file a writ in your brothers name in highcourt.

Well in this case the if you can proof the first mariage and legitimacy of child and can get a legal heir then only collector can do something .
In any case a pension drawer have liabilty to maintain the dependents of the deceased such as disabled son and unmarried daughters ,
So the best legal available option lie with you is to file a maintenance suit against step mother to maintain the disabled son.

who soever if his name has been written on d pension book he z entitled 2 get pension.in ur case plz bring d issue of mentally challenged son b4 d pension divison authority.if he does not take any action against him go 2 high court in writ petition.
