Whether old parents are liable to maintain their adult daughter

19-Sep-2023 (In Family Law)
Hi, my sister is a mentally ill. We have done 2 marriages of her, but both last due to her behaviour. Just wanted to understand does she has any right to stay with us? I am asking this because she is creating lots of problems for my old parents.

Please note that the parents would be legally bound to maintain the daughter if the following provisions of Section 125 of Cr.P.C. are fulfilled:
125. Order for maintenance of wives, children and parents.
(1) If any person having sufficient means neglects or refuses to maintain-
(c) his legitimate or illegitimate child (not being a married daughter) who has attained majority, where such child is, by reason of any physical or mental abnormality or injury unable to maintain itself

you need to inform the status of the last marriage, wheather she got the divorced from his last husband or not which is very crucial . If the divorce is not final and maintenance is not giving by the husband she can claim it from his husband or she has full right to stay in that house. otherwise, if she is working anywhere or no source of income she has to stay at the parents home.
