Torturing and harassing both comes under the purview of domestic violence, whether its physical or mental. You can file a complaint in the court under various sections of domestic violence act and criminal procedure code seeking relief from such harassment, you are suffering from, for yourself and for your kids.

At this stage, when your kids have grown up and if the torture are unbearable then better to file divorce on contested grounds and seek alimony. The court must listen you and do justice with you. Bettet part your kids can be witness from your side.

If you wish to, you can get a divorce from him on the basis that he is cruel to you and your children. Cruelty has a wide scope so need to give ample evidence that it actually occurred. Since your children are also there they can also come to court to stand on your side which would really help you in getting divorce. Also you can also move an application for 125 Cr.P.C. to get maintenance from your husband.
