What to do if there are issues in inheritance of the property

I own a house in Tolichowki area (Hyderabad) which was purchased by me over 28 years ago and it is registered in my name. Me and my family follow Islam. After my death, I like to make my wife sole owner/guardian of this property till she passes away. I want to make sure that none of my children or their spouses should be able to demand their property share during her life. I have a Son and two daughters and all of them are married and have children. As per Islamic law I want my son to have 50 percent and 2 daughters 25 percent each of the property that is ONLY AFTER THE PASSING AWAY OF THEIR MOTHER. Please advise if I should get the property Registered in mine and my wife's name (ownership by either or survivor) or make a Will accordingly.

You can jointly register the property under a proper conveyance, the clauses of the deed shall be properly drafted, failing which it becomes a subject matter of dispute after any of you passes away. A joint ownership &co-ownership are different under the property Act. A will is also an alternative but as per Sharia law, you can transfer not more that 1/3 of your property to any single person. hence, first option is suitable in your case. consult for further details

Dear Client,

As mentioned in the above lines, you just make a will deed and register it with whatever the conditions you want to put in. that is the best way to secure and protect till death of parents.
