I AM 35 YEARS LADY. LIVING SEPARATELY SINCE 9 YEARS. I HAVE APIED FOR DIVORCE AND RESULT WILL COME IN APRIL. IN MEAN WHILE I CONNECTED WITH A MAN WHO WAS ALSO DIVORCEE. WE ARE IN RELATIONSHIP FOR 2.7 YEARS. WE WAS COMMITTED TO GET MARRIAGE WITH EACH OTHER. WE ALSO APPLIED FOR MARRIAGE IN ARYA SAMAJ MANDIR BUT MY DIVORCE DECISION HAS NOT COME HE POSTPONED THE MARRIAGE DATE. NOW HE HAS TOTALY DINED FOR MARRIAGE. WE WAS IN SERIOUS RELATIONSHIP SO WE HAD MADE CLOSE RELATIONSHIP. NOW I AM TOTALLY DEPRESS. I EANT TO.DO COMPLAINT AGAINST HIM BT HE IS SAYING THAT BECOUSE I AM NOT DIVORCEE SO I CAN'T GO TO THE POLICE. I HAD MEDE SEXUAL RELATION ALSO BECOUSE I THOUGHT HE WILL GET MARRY WITH ME. SO WHAT CAN I DO NOW. PLZ SUGGEST.
You can file a case under Section 376 and 377 ipc. As you are living separately from your first husband. If you were living in a common house or were in living relation you can also file a case under Domestic violence Act and take maintenance from him.

but apart from this yes you can file rape case and also file complaint against that person ..

Pending the result of divorce case filed by you,you have yourself committed two wrongs ,first by getting into relationship with other man and then trying to get married again before getting divorce .As you are a consenting party to the relationship with other man during subsistance of your first marriage.,normally there is no chance of proceeding against the man ,who is now denying to marry you after divorce is granted to you.You wait for order in Divorce case to come and if divorce is granted to you,you may speak to the person or write to him regarding his promise to marry you after your divorce .In case he is willing to marry you after your divorce ,it is OK ,otherwise instead of filing some case against him and wasting time and resources ,without being certain of any favourable outcome of case filed ,you can look for another suitable partner and go ahead with marriage .

You can file a criminal case against him under section 376 Indian Penal Code, 1860 for committing rape under the false promise to marry. Now he has flatly denied to marry you at any cost whether you get divorce or not and even he is not in contact with you. You have to prove that from the initial stage the accused had no intention to keep promise of marriage.
