Only if ni family court is establishrd in your district than u can present application for mutual divorce before district judge. If family coutt is there u have to file 13b application for mutual divorce before concerned family court personally. A6 month coolong period is there in the act after six month court will give u divorce. That day also u hav to appear personally (both)

Dear Queriest, As per your query you have asked for procedure for Mutual Divorce, which can be filed under section 13B of the Hindu Marriage Act, 1955. Waiting period to dissolve marriage is required for at one year from date of marriage, and should be filed mutually by filing affidavit of both parties with the Petition

This is my response to you:
1. You will need to collect all the documents of your marriage;
2. You will need to engage one lawyer;
3. Then you must file a petition in court;
4. The judge will ask about the terms of divorce, cooling off period etc.;
5. Consult a local lawyer and start with the process.
