What is the best option to inherit the mother's property

My mother plans to leave a house on my name in his Will. I have a sister who already inherited a property with my father in a co- ownership. I am a NRI (USA) and it isn't very practical for me to attend court proceedings. Considering this, what is best option for inheriting the property- Will or joint ownership?

In a joint ownership, there is always a scope of claim by the other person of his/her where in such property. The same rule applies in case your mother does without aleanating has property in a proper manner. In case of a will you have to go through a legal procedure. My advice would be to ask your mother to gift such property in your name.

Your mother can gift in favour of you her undivided share of the property. Stamp duty and registration fees are very nominal and then and there joint undivided share will be transferred in favour of you.

Since ur question relates to inheriting a property from ur mother. First and foremost u must know that there is no shortcut. Secondly you should take each and every steps v carefully to avoid any nature of problem later. Since ur sisters are also ur mother's child u may take a no objection from them stating that they have no objection if in case u inherit property from you mother. Thirdly u always inherit the property by way of will. You should go for will. If it's a joint property and your mother dies intestate (without making a will), then all the legal owner will get the equal share of her share in the property. If you want absolute ownership then ask you mother to make a registered will.
