Welfare and Maintenance of Senior citizen

Me,my husband and 2 children were living in my Father's house.I am his daughter.He filed a case in Senior citizens court that he wants us to vacate his house,and he filed a complained in the police station that if he died me and my husband would be responsible.We vacated his house last year and living on rent.Now after 1 year again he is threatening us to take care of him otherwise he will file a complaint and also go to the SDM court to file a case.What should we do?Are we liable to take care.

You should get an FIR lodged against him for dowry demand and cruelty to counter his illegal demands. This way he will back off or else he'll keep troubling you guys. For assistance you may consult me.

If you have the earlier order and the present address different from the place which you had earlier then you do not have any liability to take care of your father. Also according to the Law of the Land it is advisable to give in writing to the court about the same. if your father wants to file a case of non maintenance then he has no case for you. it is just a threatening remark. be aware of that

The law mandates children to take care of their family. Be it husband taking care of the wife, or earning wife taking care of her husband. Parents taking care of the children and at advance age, children taking care of parents. The property has to be inherited by the children, there is no second thought to it, but this is not the sole reason why children respect, obey and serve their elderly parents. At their advance age they need someone to take care of them, may be in financial terms, may be physical support. In my opinion you should not take this to the court and rather do as much as you can to your father. Courts would ask you to consider. Think of a workable situation.

As far as the maintenance of your father is concerned you are legally liable to maintain him if he applies for it before the court under section 125 CrPC. And even if he approaches the court you can always keep your written defence ready that he was the one who complained about you in the PS. And also attach the copy of the complaint in WS. And as a precaution you should also file a complaint to the police station of your area. For more legal assistance I am just a call away.

hello madam as per the facited by in the question earlier father wanted you to vacate the house which you do lead dead now is asking to take care of him you can please appear before the SDM and state that if you taking care in if he again make any allegations against you that order file an appropriate reply for a better discussion please reach out to US and share the application that he is file before the SDM

it is advised to you that you file a case of injunction against such a person so that he may not be forced to take any such coercive action against you. However it is advised that one should take assistance from the competent person to seek proper help
