Want to sell my house but my husband is not vacating it

13-Dec-2023 (In Family Law)
I along with my daughters (1 married and 2 unmarried) stay in a rented house for past 10 years. My husband lives in the house registered in my name. We are not legally divorced. I want to sell the house to meet financial expenses for daughters marriage but my husband is not vacating. I even told him to give a share of the property.

You may send him a legal notice asking him to vacate the house and deliver up vacant possession to you on or before a set deadline. If no response, file an eviction suit at the proper court having jurisdiction over the property in question.

As you are the lawful owner and vested with absolute interest over the property, your husband has trespassed and should be forced to vacate.

You need not divorce to get him out of the house.
